Some Disney charges lack evidence: judge
The jury in the trial of television identity Gavan Disney has been ordered to return verdicts of not guilty on three indecent assault charges due to a lack of evidence.
But Disney, the co-creator of the Nine Network's long-running program Hey Hey It's Saturday, is still fighting another 10 counts of indecent assault and two of rape.
Disney is on trial in the County Court, sitting in Ballarat, accused of assaulting a teenager with whom he worked at Ballarat television station BTV6 almost 30 years ago.
The 60-year-old has pleaded not guilty to all charges.
On Friday, County Court Judge Paul Lacava directed the jury to make a finding of not guilty on the three indecent assault counts because of insufficient evidence.
The jury has heard the abuse began soon after the alleged victim joined the station in 1980 at 17.
Disney will be cross-examined when he takes the witness stand on Monday.
